AGREEMENT TO THE TERMS

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you, whether personally or on behalf of an entity (“you”) and EasyClaimAir (“Company”, “we”, “us”, or “our”), concerning your access to and use of the EasyClaimAir website created on the Wix.com platform (the “Site”).

EasyClaimAir is a sole proprietorship owned by Theodosis Stylianou, a natural person, registered and operating in the Republic of Cyprus, with its registered office at John Kennedy 56, 1076, Nicosia, Cyprus.

By accessing and using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you are prohibited from using the Site and must discontinue use immediately.

We may amend these Terms from time to time. Any modifications will be effective upon posting on the Site, with the “Last Updated” date reflecting the most recent changes. Continued use of the Site constitutes your acceptance of such amendments.

The Site is intended for users who are at least 18 years of age. Persons under 18 are not permitted to use or register for the Site.

PURPOSE OF THE SITE

EasyClaimAir assists air passengers in exercising their legal rights under Regulation (EC) No. 261/2004 and other applicable EU and Cyprus legislation governing air passenger rights. By submitting your personal and flight details, you authorize EasyClaimAir to act on your behalf to communicate with airlines and, if necessary, initiate legal proceedings to secure your compensation.

Our service is provided on a contingency fee basis:

  • 35% commission on compensation received without litigation.

  • 50% commission if legal action is necessary.

No fees are charged upfront; commission is deducted only from successfully recovered compensation.

INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, all content on the Site (text, graphics, logos, design, and underlying software) is owned or licensed by EasyClaimAir and protected under EU and Cyprus copyright and trademark laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Site solely for personal, non-commercial purposes related to air passenger rights claims.

USER REPRESENTATION

By using the Site, you confirm that:

  1. You have the legal capacity and authority to enter into these Terms.

  2. All information you provide (personal details, flight details, etc.) is true, complete, and accurate.

  3. You will not use the Site for unlawful purposes.

  4. You authorize EasyClaimAir to act on your behalf before airlines and, where necessary, in legal proceedings related to your claim.

PERSONAL DATA PROTECTION

We process personal data strictly in compliance with the General Data Protection Regulation (EU) 2016/679 (GDPR)and the Cyprus Data Protection Law.

  • Data collected includes identification details, contact information, and flight details.

  • Data is used exclusively for processing claims and, where required, legal representation.

  • Data may be shared with airlines, courts, and our legal representatives for the sole purpose of enforcing your claim.

  • Your data is securely stored and hosted on Wix.com servers, which may be located in the EU or outside the EU with adequate safeguards.

THIRD-PARTY SERVICES

The Site is hosted on Wix.com, and we use third-party services (including payment processors, cloud storage, and legal representatives). We are not responsible for the privacy practices or policies of such third parties.

COMPENSATION POLICY

Compensation payments are processed through secure third-party channels. You expressly authorize us to deduct our commission (35% or 50%, depending on whether legal action was required) from the compensation before remitting the balance to you.

Invoices and receipts will be issued electronically.

SITE MANAGEMENT AND AVAILABILITY

We reserve the right to monitor and restrict use of the Site in case of misuse, modify or suspend access at any time without liability, and correct errors or update content as necessary. While we strive to ensure smooth operation, we cannot guarantee uninterrupted availability due to hosting, maintenance, or other technical issues.

GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the Republic of Cyprus.

DISPUTE RESOLUTION

Any dispute shall first be addressed through amicable negotiations. If unresolved, disputes will be submitted to the competent courts of Cyprus.

DISCLAIMER

The Site is provided on an “as-is” basis. While we make every effort to ensure accuracy, we do not warrant uninterrupted service, complete accuracy of content, or outcomes of claims. Compensation eligibility and amounts are determined by applicable EU regulations and airline responses, not by EasyClaimAir.

INDEMNIFICATION

You agree to indemnify and hold EasyClaimAir harmless against any claims or liabilities arising from:

  • Misrepresentation of your details.

  • Fraudulent or unlawful use of our services.

  • Breach of these Terms.

MISCELLANEOUS

These Terms, together with the Privacy Policy, constitute the entire agreement between you and EasyClaimAir.

If any provision is found invalid, the remainder shall continue in force.

Our failure to enforce any right under these Terms does not constitute a waiver.
