Compensation Policy

INTRODUCTION

This Compensation Policy (“Policy”) governs the process by which EasyClaimAir, a sole proprietorship registered in the Republic of Cyprus and operated by Theodosis Stylianou, assists air passengers in pursuing compensation claims under Regulation (EC) No. 261/2004 (“EU 261”). By engaging our Services, you agree to the terms outlined in this Policy.

SCOPE OF THIS POLICY

This Policy applies to all claims for compensation relating to flight delays, cancellations, and denied boarding, as regulated by EU 261 and interpreted by the Court of Justice of the European Union (CJEU).

EasyClaimAir acts as your representative in filing and managing claims against airlines, including correspondence, negotiation, and, if necessary, legal action through our partner law firms or external legal counsel.

ELIGIBILITY

To be eligible for compensation under EU 261, you must:

  • Hold a valid booking and present yourself for check-in as required;

  • Have experienced a flight delay of three (3) hours or more, cancellation, or denied boarding; and

  • Fall within the jurisdictional scope of EU 261 (flights departing from the EU/EEA/Switzerland, or flights arriving in these territories on EU carriers).

Certain exemptions apply, including but not limited to:

  • Extraordinary circumstances outside the airline’s control (e.g., extreme weather, air traffic control strikes, political instability, or security risks);

  • Passengers traveling free of charge or on discounted fares not available to the public.

COMPENSATION AMOUNTS

Compensation is determined by EU 261 and is as follows:

  • €250 for flights up to 1,500 km;

  • €400 for flights between 1,500 and 3,500 km;

  • €600 for flights over 3,500 km (outside EU/EEA).

OUR REMUNERATION

EasyClaimAir charges no upfront fees. Our remuneration is contingent upon the successful collection of compensation.

The commission structure is as follows:

  • 35% (Plus VAT, where applicable) of the total compensation amount if resolved directly with the airline, without legal proceedings;

  • 50% (Plus VAT, where applicable) of the total compensation amount if legal proceedings are required.

Commission is deducted from the compensation received before transferring the balance to your designated bank account.

PAYMENT OF COMPENSATION TO THE PASSENGER

Once the airline remits compensation, EasyClaimAir deducts its commission in accordance with this Policy.

The remaining balance is transferred to the passenger’s bank account details provided to EasyClaimAir during the claim process.

Transfers are processed within 7 business days from the date funds are cleared in our account.

LEGAL PROCEEDINGS

If the airline rejects or fails to respond to the claim, EasyClaimAir may initiate legal proceedings in cooperation with external lawyers.

You expressly authorize EasyClaimAir and its designated legal partners to represent you before courts or competent authorities.

In the event legal proceedings are unsuccessful, no fees will be charged to you.

PASSENGER OBLIGATIONS

You agree to:

  • Provide complete and accurate information and supporting documentation (e.g., booking confirmation, boarding pass);

  • Refrain from parallel negotiations with the airline after assigning the claim to EasyClaimAir;

  • Notify EasyClaimAir immediately if you receive any direct payment or communication from the airline.

Failure to comply with these obligations may entitle EasyClaimAir to recover its commission as if the compensation had been received through our intervention.

LIMITATION OF LIABILITY

EasyClaimAir shall not be liable for:

  • The outcome of the claim or the time required for resolution;

  • Any indirect or consequential losses.

Our liability, where applicable, shall be limited to the amount of commission received for the specific claim.

GOVERNING LAW 

This Policy is governed by and construed in accordance with the laws of the Republic of Cyprus. Any dispute shall be submitted to the exclusive jurisdiction of the courts of Cyprus.
